Royalties are an important budgetary source for a restricted group of Brazilian entities, as their distribution is marked by asymmetries with profound disparities. This research addresses the issue of development induced by the current Brazilian model of royalty distribution, using Ilhabela as a case study. The work begins by presenting the evolutionary framework of royalties and emphasizes the complex Brazilian legislation on distribution. Subsequently, the peculiarities of Ilhabela are analyzed in three axes: education, sanitation, and productive and revenue diversity. The methodology employed is documentary in nature, using qualitative and quantitative techniques, focusing on analytical-exploratory data analysis and legislative research. The investigation’s results show that, in Ilhabela, despite the royalties, the indicators of education and sanitation do not meet the projected targets, below the average of São Paulo municipalities. Regarding productive and revenue diversity, although the municipality demonstrates the good practice of the sovereign fund (FSRI), its financial solidity would be severely compromised without the royalties. Moreover, the findings reveal a growing wave of litigation by municipalities interested in claiming portions of the royalties and, on the other hand, there is the inertia of the Supreme Federal Court (STF), which has kept suspended, through a single-judge injunction from 2013, Law No. 12.734/2012, a norm that would promote a more balanced distribution. The research aims to contribute to deepening the debate by encouraging a comparative analysis of Brazilian legislation with international benchmarks.
